The purpose of this Privacy Policy is to inform you, as clearly and comprehensively as possible, about how your personal data is processed, whether you are simply visiting our website www.ressencewatches.com or making a purchase as a customer.
1. Who processes your data?

2. What data is collected?
2.1. The data you provide us as a customer:
- identification details: your full name, e-mail address and phone number
- delivery details: your billing and delivery postal addresses
- payment details (including credit card number).
The mandatory or optional nature of the data (for example, in order to fulfil your orders and to open and manage your account if you choose to create an account) is indicated at the time of collection by an asterisk. Please note that we will be unable to process your orders if you fail to complete the mandatory data fields.
2.2. Data collected automatically when you access our website (using cookies, log files, web beacons, tags or pixels): connection and browsing data (language of your choice, time zone, contact identifiers, TCP/IP address, type and version of your browser, referring domain and pages visited, search terms and how you interact with the website).

3. For what purposes and on what legal bases is your data processed?
Your data is collected and processed for the following purposes:
- in order to supply you with the products ordered, as part of the performance of the contract or to take pre-contractual measures (opening and management of your optional customer account, shipping and delivery of ordered products, commercial and accounting management of orders, management of complaints and outstanding payments, etc.);
- for RESSENCE legitimate interests:
· to improve the quality and suitability of our products;
· to improve our communication with you;
· to analyse data (in particular site traffic statistics, monitoring of opening rates, click rates and bounce rates at individual level, statistics based on previously anonymised data).
In doing so, we will always ensure that a balance is struck between our legitimate interests and the protection of your privacy. Under no circumstances will profiling be used to make automated decisions that could have negative consequences for you.
- with your consent: for sending our newsletters or information about our products and for cookies that are not strictly technical or functional, it being understood that you have the right to withdraw your consent at any time (see point 8below).
- in order to comply with the applicable legal and regulatory obligations, particularly in terms of employment law, accounting and tax obligations, and the protection of personal data.
4. How long is your data stored?
Your personal data is stored for as long as is necessary for the purposes indicated when it was collected (for cookies, see the specific periods mentioned in our Cookie Policy: https://ressencewatches.com/pages/cookie-policy). When your data is used to process your orders, it is stored for the legal limitation period or for any other retention period required by law.
5. To whom is your data transferred?
RESSENCE undertakes not to sell, rent or transfer your data to third parties. In order to supply its products, we may communicate your data to our subcontractors or to business partners.
5.1. Subcontractors
In order to ensure the proper functioning of our website and to process your orders, we call upon specialised partners who act as subcontractors and are contractually bound to us. They must follow our instructions, respect the confidentiality of the data received from us and may not use them for any purpose other than to perform services on our behalf.
5.2. Business partners
With your consent or if justified by a legitimate interest, RESSENCE may transfer some of your data to business partners, who act as "data controllers" in relation to the processing of your data.

6. How is your data secured?
In order to best protect your personal data, RESSENCE has implemented appropriate technical and organisational security measures to prevent the destruction, loss, misuse, alteration, modification, unauthorised access or disclosure of such information.
We use industry-standard SSL encryption to protect data transmissions and also protect your personal data against unauthorised access by means of access control procedures, firewall networks and physical security measures.
It is therefore important that you cooperate with these security measures, in particular by preventing any unauthorised access to your user name and password.
7. Transfer of personal data to third countries
Your personal data will only be transferred or disclosed to processors or data controllers in third countries where we are legally permitted to do so.
Where necessary, appropriate measures will be taken to ensure that your personal data is meaningfully protected and that such disclosures or transfers outside the EEA are lawful and legitimate. If a disclosure or transfer takes place to a country not recognised by the European Commission as offering an adequate level of protection, such disclosure or transfer will be subject to the conclusion of standard contractual clauses as established by the European Commission or to the adoption of binding corporate rules.
Your personal data will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. 8. What are your rights and how can you exercise them?
You have a right of access, a right of rectification, a right to erasure and a right to portability of your data. Under certain conditions, you also have the right to oppose the processing of your data or to have it restricted.
These rights are free of charge and may be exercised at any time.
- Right of access: you have the right to access your personal data and to receive a copy of it.
- Right of rectification: you have the right to have incorrect or obsolete data corrected. If you have an account, you can rectify or update the data yourself.
We take all reasonable steps to ensure that the data we hold is up to date and to delete data that proves to be incorrect or is no longer required for processing.
- Right to erasure ("right to be forgotten"): in certain circumstances (for example where the data processed is no longer necessary for the purpose of the processing), you have the right to ask us to delete your data.
- Right to restrict processing: you may request that we restrict the processing of your data,
in which case your data will no longer be processed (but will be stored).
- Right to portability: you have the right to obtain that the data you have provided us with is sent to you in a structured, commonly used and machine-readable format.
- Right of opposition: where the processing of your data is based on our legitimate interest, you have the right to oppose this processing at any time, for reasons relating to your particular situation. In this case, however, RESSENCE will have the right to oppose you legitimate and compelling grounds justifying the continued processing.
Please note that you have the right to oppose, at any time and free of charge, the processing of your data for canvassing purposes (direct marketing) without any exception being able to be raised against you. This also includes the right to oppose profiling insofar as it is linked to such prospecting.
- Withdrawal of consent: where processing of your data is based on your consent, you may withdraw it at any time. Such withdrawal will not affect the lawfulness of the processing of your data carried out prior to the withdrawal.
In the context of prospecting (direct marketing), this means that you can unsubscribe from newsletters and other commercial communications at any time by contacting us at hello@ressence.be or by clicking on the unsubscribe link at the bottom of each e-mail.
- Right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.
We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.
Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.
Services that include elements of automated decision-making include:
· temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
· temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

Any request relating to your rights must include your full contact details (surname, first name, e-mail, full postal address) and be accompanied by a copy of both sides of your identity card, in order to prevent misuse and guarantee the security of your data.
9. Where can you lodge a complaint about the processing of your data?
If you believe that there has been a breach of the legislation on the protection of personal data, you can lodge a complaint with the Belgian Data Protection Authority:

10. Protection of minors
We remind you that minors are not authorised to place orders on our website and that customers expressly declare that they are of legal age and capable of entering into a contract.
If you become aware that your child has provided us with personal information without your consent, please notify us at hello@ressence.be. We do not knowingly collect personal information from minors. If we learn that a minor has provided us with personal information, we will take the necessary steps to delete this information and close the minor's account within a reasonable period of time.
11. Updates
We may update this Privacy Policy from time to time in order to reflect, for example, changes in our practices or for other operational, legal, or regulatory reasons.
